Payment
Each payment by the Buyer may only be made using one of the methods indicated in the purchase form/module.
All communications relating to payments take place on a dedicated Seller line protected by an encryption system. The Seller guarantees the storage of this information with an additional level of security encryption and in compliance with the provisions of the current legislation on the protection of personal data.
At the same time as the confirmation and order summary email is sent, the amount corresponding to the product(s) purchased will be charged to the Buyer. In the event that, for any reason, the debiting of the amounts due by the Buyer does not occur, the sales process is automatically cancelled and the sale automatically deleted.
The Seller will issue the receipt of purchase of the product(s), sending it via email to the person placing the order within 48 hours of the confirmation email and order summary or making it available on the Buyer’s personal page. The information provided by the Buyer will be used to issue the receipt. No changes to the data will be possible after the receipt itself has been issued (or the invoice if requested by the Buyer).
Payment Methods
CREDIT CARD – The payment system currently accepts Mastercard, Visa, American Express, Discover cards. In the case of purchasing goods with a Credit Card payment method, at the same time as the online transaction is concluded, the relevant banking institution will authorize the credit for the amount relating to the purchase made.
PAYPAL – By choosing this option you will be directed to the PayPal site to complete the transaction. When you place your order, PayPal will immediately charge the amount for your purchase. Find out more about PayPal.
APPLE PAY/GOOGLE PAY
CASH ON DELIVERY – It will be possible to pay by cash on delivery, upon delivery of the order. By choosing this payment method, an additional cost of € 6 will be charged.
SHIPPING
Costs and times – The Seller will deliver the product(s) selected and ordered, using the methods chosen by the Buyer or indicated on the website at the time the product is offered. Delivery times vary from 3 to 5 working days from the date of the order for shipments to Italy. Shipping and delivery times may vary from the day of the order to a maximum of 30 working days from confirmation of the order and are made known to the Buyer at the time of order confirmation. Shipping costs, unless otherwise indicated, are the responsibility of the customer and are specified during the checkout process, before the order is concluded. These costs are calculated automatically based on the weight/volume of the products purchased and the destination area.
Note: An additional fee will be charged for payment by cash on delivery.
Track your shipment – When your order is shipped, as soon as the package is handed over to the courier, an email is sent containing all the information you need to check the status of your shipment directly from the courier’s website.
Size Exchange Policy
We offer the possibility of size exchange for items purchased on our site within a period of 14 days from the date of delivery.
The customer is responsible for communicating the need for size exchange within the specified period and returning the original item.
The shipping costs for the return of the original item are the responsibility of the customer.
The customer is responsible for the correct packaging of the returned item to ensure its integrity during transport.
Please include a note with the name, address and order number inside the return package to facilitate the size exchange process.
Shipping the new item:
Once we receive the original returned item, we will ship the new item in the requested size.
Shipping costs for the delivery of the new item are at our expense and will be managed according to our standard shipping methods.
Size Exchange Conditions:
The returned item must be in new and unused condition, with all original tags and packaging intact.
Damaged or soiled products will not be accepted for size exchange.
Size exchange is subject to the availability of the desired sizes. If the requested size is not available, the customer may opt for a refund or an alternative item of equal value, upon agreement.
Processing times:
Once we receive the returned item and verify its condition, we will process the size exchange request as quickly as possible.
Please note that processing times may vary depending on the volume of requests and warehouse conditions.
Refund Policy:
In the event that we are unable to accommodate your size exchange request, we will offer a full refund of the amount paid for the returned item, excluding the original shipping costs.
Returns and Refunds
The Buyer has the right to withdraw from the product purchase contract within 14 (fourteen) calendar days (so-called “Withdrawal Period”).
The “Withdrawal Period” expires 14 (fourteen) days after:
a) in the case of an order relating to a single product, the day on which the Buyer or a third party, other than the carrier and designated by the Buyer himself, acquires physical possession of the product;
b) in the case of a Multiple Order with separate deliveries, the day on which the Buyer or a third party, other than the carrier and designated by the Buyer himself, acquires physical possession of the last product;
c) in the case of an order relating to the delivery of a product consisting of multiple lots or pieces, the day on which the Buyer or a third party, other than the carrier and designated by the Buyer, acquires physical possession of the last lot or piece.
To exercise the right of withdrawal, the Buyer must inform the Seller, before the expiry of the “Withdrawal Period” of his decision to withdraw. To this end, the Buyer may: submit an explicit declaration of his decision to withdraw from the contract (“Withdrawal Declaration”), by sending an email to the following address: shop@ducatipalermo.it.
The Buyer has exercised his right of withdrawal within the “Withdrawal Period” if the communication relating to the exercise of the right of withdrawal is sent before the expiry of the “Withdrawal Period”. In the event that the Buyer makes use of the “Withdrawal Declaration”, it is advisable to indicate the order number, the product(s) for which he/she intends to exercise the right of withdrawal and his/her address.
The “Withdrawal Declaration” must be sent to the following address shop@ducatipalermo.it.
The Seller may reserve the right to withhold the refund until it has received the goods or until the Buyer has demonstrated that they have been sent back, whichever occurs first.
The Buyer is responsible for the decrease in value of the product resulting from its handling other than that necessary to establish its nature, characteristics and functioning. The product must in any case be stored, handled and inspected with normal diligence and returned intact, complete in all its parts, perfectly functioning, accompanied by all accessories and information sheets, with the labels, if present, still attached to the product, as well as perfectly suitable for the use for which it is intended.
Return of goods and refund times and methods – The Buyer who intends to exercise his right of withdrawal must also return the product to the Seller, using a carrier of his choice and at his own expense, without undue delay and in any case within 14 (fourteen) calendar days from the date on which he communicated his decision to withdraw to the Seller. The deadline is respected if the Buyer sends the product back before the expiry of the 14 (fourteen) day period. The product, together with the original receipt, and appropriately packaged, must be sent to the following address: Via Ugo la Malfa n. 4, city of Palermo (PA), Postcode 90146. The direct costs of returning the product(s) to the Seller are borne by the Buyer.
If the Buyer withdraws from the contract, the Seller will refund the total amount due paid by the Buyer for the product, including delivery costs, without undue delay and in any case no later than 14 (fourteen) calendar days from the day on which the Seller was informed of the Buyer’s decision to withdraw from the contract.
The refund will be made using the same means of payment used by the Buyer for the initial transaction, unless the Buyer has expressly agreed otherwise. In any case, the Buyer will not have to bear any additional costs.

Acceptance of the general conditions of sale
1. The contract stipulated between NICOLO’ RIOLO S.P.A. and the Customer must be considered concluded with the acceptance, even partial, of the order by NICOLO’ RIOLO S.P.A. Such acceptance is considered tacit, unless otherwise communicated in any way to the Customer. By placing an order in the various ways provided, the Customer declares that he has read all the information provided to him during the purchase procedure, and that he fully accepts the general and payment conditions transcribed below. These General Conditions of Sale, as published and accepted by the Customer at the time of purchase and/or at the time of registration on the Site, exclusively and specifically regulate every purchase completed through the site between the Seller and the Customer, regardless of their nationality.
2. The Customer, once the online purchase procedure has been completed, will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of articles 49 and following of Legislative Decree no. 206/2005 on distance selling.
How to purchase
3. The Customer may purchase only the products present in the electronic catalogue managed by NICOLO’ RIOLO S.P.A. at the time of placing the order, viewable online at the address (URL) www.ducatipalermoshop.it, as described in the relevant information sheets. It is understood that the image accompanying the description sheet of a product may not be perfectly representative of its characteristics but may differ in colour, size, accessory products present in the figure. All information supporting the purchase is to be understood as simple generic information material, not referable to the real characteristics of a single product.
4. Correct receipt of the order is confirmed by NICOLO’ RIOLO S.P.A. by means of an e-mail response, sent to the e-mail address provided by the Customer. This confirmation message will report the Date and Time of execution of the order and a ‘Customer Order Number’, to be used in any further communication with NICOLO’ RIOLO S.P.A. The message will repeat all the data entered by the Customer who undertakes to verify its correctness and to communicate any corrections promptly, according to the methods described in this document. We always undertake to guarantee the correctness of the information published on the site, but the breadth of the catalogue and the amount of information contained therein entail the possible risk of a technical problem that mistakenly generates a sales price different from the actual one. We therefore reserve the right to cancel the order in the event of incorrect publication of a price; our Customer Service will take care of notifying the Customer and instructing him/her with the correct information.
5. In the event of non-acceptance of the order, NICOLO’ RIOLO S.P.A. guarantees timely communication to the Customer, providing for the reimbursement of any sums already paid as soon as possible and in any case no later than 14 days from the aforementioned communication.
Payment Methods
6. Credit Card: The payment system currently accepts Mastercard, Visa, American Express, Discover circuit cards; In the case of purchasing goods with the Credit Card payment method, the transaction will be authorized at the time of the order.
6.1 In the event of cancellation of the order, either by the Customer or in the event of non-acceptance of the same by NICOLO’ RIOLO S.P.A., NICOLO’ RIOLO S.P.A. will simultaneously request cancellation of the transaction. Cancellation times, for some types of cards, depend exclusively on the banking system. Once the transaction has been cancelled, under no circumstances can NICOLO’ RIOLO S.P.A. be held liable for any damages, direct or indirect, caused by a delay in the failure to reimburse the amount by the banking system.
6.2 NICOLO’ RIOLO S.P.A. reserves the right to request additional information from the Customer (e.g. landline telephone number) or the sending of a copy of documents proving ownership of the Card used. In the absence of the requested documentation, NICOLO’ RIOLO S.P.A. reserves the right not to accept the order.
6.3 At no time during the purchase procedure is NICOLO’ RIOLO S.P.A. able to store the information relating to the buyer’s credit card, transmitted via a protected connection directly to the site of the banking institution that manages the transaction. No computer archive of NICOLO’ RIOLO S.P.A. will store such data. In no case can NICOLO’ RIOLO S.P.A. therefore be held responsible for any fraudulent or improper use of credit cards by third parties, at the time of payment for the products purchased.
8. PayPal: By selecting the PayPal payment type, you will be redirected to a page on the PayPal website where you will enter your email address and password and make the payment. Your financial data will not be shared with NICOLO’ RIOLO S.P.A. but will be managed directly by PayPal. We only accept verified PayPal accounts. Connect to the PayPal website to verify your account.
9. Cash on delivery: In case of purchase by Cash on delivery, an additional charge will be applied to the total amount, clearly highlighted when choosing the payment method. Payment can be made exclusively in the following ways:
– with cash, exclusively up to amounts of 500 euros (pursuant to Legislative Decree 90/2017). When choosing the payment method, the customer will be informed that it will not be possible to accept payments exceeding the thresholds established by the relevant legislation.
If the customer chooses this payment method for an amount greater than 500 euros, NICOLO’ RIOLO S.P.A. will contact the customer through its customer service and propose an alternative payment method.
ATTENTION: if you pay by credit card, the beneficiary you will see on your bank statement will be NICOLO’ RIOLO S.P.A.
Delivery methods and costs
11. NICOLO’ RIOLO S.P.A. can only accept orders for delivery to the countries indicated during the purchase phase. NICOLO’ RIOLO S.P.A. reserves the right not to accept orders for delivery to locations that are particularly difficult to reach. In these cases, NICOLO’ RIOLO S.P.A. will be responsible for communicating to the Customer the non-acceptance of the Order pursuant to paragraph 5.
12. During the purchase procedure, the Customer must request NICOLO’ RIOLO S.P.A. to issue a tax invoice, if desired. In this case, NICOLO’ RIOLO S.P.A. will send it to the email address or residence address indicated during registration. For the purposes of issuing the invoice, the information provided by the Customer at the time of the Order will be valid. After the invoice has been issued, it will not be possible to modify the data indicated, therefore the Customer is invited to carefully check the data entered before proceeding with sending the Order.
If the invoice document is not requested at the time of placing the order, it cannot be issued subsequently under any circumstances. The sales system of NICOLO’ RIOLO S.P.A., as an online seller, does not require the issuing of an invoice (or receipt or tax receipt) to a consumer (not a VAT number holder), according to art. 22 of the Presidential Decree of 26/10/1972 n. 633 and article 2, letter oo) of the Presidential Decree of 21 December 1996, n. 696 (as confirmed by Resolution n. 274/E of 5 November 2009). If the invoice is not requested by the Customer, NICOLO’ RIOLO S.P.A. will still send the consumer a purchase receipt, without tax validity, to the email address or residence address indicated during registration, which is only useful for assistance or warranty purposes.
13. Delivery costs are the responsibility of the customer and are explicitly reported at the time of placing the order. The payment for the goods by the Customer will be made using the method chosen at the time of ordering. Nothing more is due by the Customer than the total of the order.
14. The availability of the products on sale is limited to the availability of the products themselves and is a condition for the validity of the offers. In the event of exhaustion, even temporary, of the stocks, NICOLO’ RIOLO S.P.A. has the right to refuse the customer’s purchase request by means of a formal communication via e-mail, in which any available replacement products of equal or higher value than the one purchased may also be indicated, with payment by the Customer of any price difference. Except in the case in which the customer requests to purchase a product to replace the one that is out of stock, NICOLO’ RIOLO S.P.A. will refund any sums already paid by the Customer as soon as possible and in any case no later than 14 days from the date on which the order was cancelled. The requested products are delivered in the shortest time possible, normally within 5 / 7 working days. NICOLO’ RIOLO S.P.A. undertakes to respect, as a maximum delivery time, a period not exceeding 30 days, except in cases of force majeure. The maximum delivery time is calculated from the date of conclusion of the contract. In the event of a delay exceeding 30 days, the Customer and NICOLO’ RIOLO S.P.A. will agree on the possible new delivery date if the Customer does not declare his intention to withdraw from the sales contract by communicating it via email to the address: shop@ducatipalermo.it.
15. Unless otherwise specified by NICOLO’ RIOLO S.P.A. Customer Service, delivery is intended to be at street level. Upon delivery of the goods by the courier, the Customer is required to check: 1) that the number of packages delivered corresponds to that indicated in the transport document sent in advance via email; 2) that the packaging is intact, not damaged, not wet or otherwise altered, including the sealing materials (adhesive tape or metal straps). Any damage to the packaging and/or the product or the lack of correspondence in the number of packages or indications must be contested immediately, by placing a WRITTEN RESERVATION OF CONTROL on the courier’s proof of delivery. Once the courier’s document has been signed, the Customer will not be able to raise any objections regarding the external characteristics of the goods delivered. Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 8 days of delivery by email to the address: shop@ducatipalermo.it, without prejudice in any case to the Customer’s right to the legal guarantee of conformity referred to in the following point 21 and following and to the right of withdrawal referred to in the following point 16 and following.
16. In the event of failure to collect the material stored in the courier’s warehouses within 5 working days due to repeated impossibility of delivery to the address indicated by the Customer when ordering, the sales contract will be considered terminated with reimbursement of the relative price paid by the Customer.
Right of withdrawal
17. Pursuant to articles 52 et seq. of Legislative Decree 206/2005, if the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his/her professional activity), he/she has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, with the exception of the types of products for which this is expressly excluded (see art. 59 Legislative Decree 206/2005) and without prejudice to what is indicated in the following point 17.
18. The right of withdrawal may be exercised within 14 days of receiving the product in the following ways: the Customer shall send an email to: shop@ducatipalermo.it. The Customer must indicate the Order Number and photos of the product. The return of the product must take place at NICOLO’ RIOLO S.P.A., Via Ugo la Malfa, 4, 90146 Palermo PA, within 14 days of the date of exercising the right of withdrawal. The costs of re-shipping the returned product are entirely borne by the Customer who intends to withdraw from the purchase.
19. The right of withdrawal is however subject to the following conditions:
– the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased (e.g.: accessories, etc.);
– the purchased item must be intact and returned in its original packaging, complete in all its parts (including the original receipt, packaging and any documentation and accessory equipment: manuals, etc.); to limit damage to the original packaging, we recommend, when possible, placing it in a second box, on which to affix the label provided by NICOLO’ RIOLO S.P.A., showing the RMA number (return authorization code); in all cases, affixing labels or adhesive tape directly onto the original packaging of the product must be avoided;
– the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer;
– in the event of damage to the goods during transport, NICOLO’ RIOLO S.P.A. will notify the customer of the incident (within 5 working days of receiving the goods in its warehouses), to allow the customer to promptly file a complaint against the courier chosen by him and obtain reimbursement of the value of the goods (if insured); in this eventuality, the product will be made available to the customer for its return, simultaneously cancelling the request for withdrawal; – NICOLO’ RIOLO S.P.A. is not liable in any way for damage or theft/loss of goods returned with uninsured shipments;
20. NICOLO’ RIOLO S.P.A. will refund the customer the entire amount paid, net of the direct return costs referred to in the previous paragraph 16, within 14 days of receiving the notice of withdrawal, by reversing the amount charged to the Credit Card or by Bank Transfer. In the latter case, the customer will be responsible for promptly providing the bank details on which to obtain the refund (IBAN code of the current account of the invoice holder). NICOLO’ RIOLO S.P.A. may suspend the refund until the products are received or until the Customer demonstrates that they have returned the products, if earlier.
21. Without prejudice to the fact that the customer is only responsible for the decrease in value of the goods resulting from handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods themselves, the right of withdrawal is excluded in relation to:
– damage to the product for reasons other than its transport. In the event of forfeiture of the right of withdrawal, NICOLO’ RIOLO S.P.A. will provide the relevant communication by email; the product will remain available to the Customer at the NICOLO’ RIOLO S.P.A. warehouse for a period of 30 (thirty) days from the date of sending the email. After this period, NICOLO’ RIOLO S.P.A. undertakes to return the product to the Customer by courier. Shipping costs and the price of the product, if already refunded, will be charged to the Customer.
Guarantees
22. The products sold through the Site to the Customer enjoy the legal guarantee of conformity provided for by articles 128 et seq. of the Consumer Code (“Legal Guarantee”). To benefit from the guarantee, the Customer must keep and show the invoice (or the purchase receipt or DDT) that he will receive at the time of delivery.
23. The manufacturer’s conventional warranty is provided in the manner illustrated in the documentation included in the product packaging. It is voluntary and does not replace, limit, exclude or prejudice the right to the Legal Guarantee of Conformity. The duration, territorial extension, methods of use, types of damage/defects covered and any limitations of the Manufacturer’s Conventional Warranty are elements indicated in the so-called warranty certificate contained in the product packaging.
24. The Legal Guarantee may be requested for any lack of conformity existing at the time of delivery of the product, provided that the lack of conformity has manifested itself within 2 (two) years from delivery of the product. The Customer is required to report the lack of conformity by contacting Customer Service via email at the following address shop@ducatipalermo.it; this report must contain an accurate and complete description of the contested defects or faults. In this case, Customer Service is required to acknowledge the Customer’s communication, giving instructions for shipping the defective product.
The Customer may request, at his discretion, to repair the product or replace it, at no cost to him, unless the chosen remedy is objectively impossible or excessively onerous compared to the other, taking into account all the circumstances and, in particular, those listed in Article 135-bis, paragraph 2, of the Consumer Code.
Ducati may refuse to bring the goods into conformity through repair and replacement if repair and replacement are impossible or if the costs it would have to bear are disproportionate, taking into account all the circumstances, including those referred to in Article 135-bis, paragraph 2, letters a) and b), Consumer Code.
The Customer may request, at his discretion, an appropriate reduction in the price or termination of the Contract if one of the following situations occurs: (i) Ducati has not carried out the repair or replacement or has not carried out the repair or replacement, where possible, pursuant to Article 135-ter, paragraphs 1, 2 and 3 of the Consumer Code or has refused to bring the goods into conformity pursuant to the previous paragraph; (ii) a lack of conformity occurs despite Ducati’s attempt to restore the conformity of the goods; (iii) the lack of conformity is so serious as to justify the immediate reduction in the price or termination of the sales contract; (iv) Ducati has declared or it is clear from the circumstances that it will not proceed to restore the conformity of the goods within a reasonable period or without significant inconvenience for the Customer. It remains understood that the Customer does not have the right to terminate the contract if the lack of conformity is of minor importance.
Where, after having collected the product, it is found that the reported lack of conformity actually exists, any transport, repair or replacement costs of the product will remain at the expense of Ducati. Otherwise, or where it is found that the reported lack of conformity does not exist or that the conditions for the applicability of the Legal Guarantee do not exist, the Legal Guarantee will not operate and all transport costs as well as costs related to the verification of the alleged lack of conformity will be at the expense of the Customer, who will be notified of this.
The Customer acknowledges and accepts that any defects or damages which occur after the time of delivery of the goods, such as, for example, those caused by improper use by the Customer or third parties, are not covered by the Legal Guarantee.
25. No damages can be requested from NICOLO’ RIOLO S.P.A. for any delays in carrying out repairs or replacements.
26. In cases where the application of the guarantees requires the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, accessories, etc.); to limit damage to the original packaging, we recommend, when possible, to insert it in a second box; in all cases, the affixing of labels or adhesive tape directly on the original packaging of the product must be avoided.

Applicable law
29. The sales contract between the Customer and NICOLO’ RIOLO S.P.A. is understood to be concluded in Italy and regulated by Italian Law. For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of his/her municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Fermo.
30. These General Conditions of Sale may be modified from time to time, also in response to changes in the relevant legislation. The new General Conditions of Sale will be effective with respect to the sales contracts of the Products stipulated from the date of their publication and acceptance by the Customer.
